Our tours are all about quality, fun and following the Socceroos in amazing destinations, but we still need to include the usual ‘legal stuff’ so our obligations to you are clear.

APPLICATION OF BOOKING CONDITIONS

Please carefully read these Booking Conditions as they form the basis for Green & Gold Army Pty Ltd (‘GGA’, ‘We’ or ‘Us’) accepting your (‘You’ or ‘Your’) booking for the travel arrangements available for purchase on ggatravel.com.au (Travel Arrangements) for Syria Away in Malaysia (‘Booking’).

By making your Booking with Us, you are accepting these Booking Conditions on behalf of everyone named in your Booking. You warrant that they have brought these Booking Conditions to the attention of all persons named in Your Booking and that those persons have accepted these Booking Conditions.

TRAVEL ARRANGEMENTS

Within a reasonable time of receipt of Your Booking a, We will issue you a Booking Confirmation. This will set out the Travel Arrangements you have agreed to purchase from Us subject to these Booking Conditions. It is important that you check your Booking Confirmation and notify us of any errors within 48 hours of receipt. If you fail to do this, then We are not responsible for these errors.

PAYMENTS

Payments for Your Travel Arrangements (including any international flights) are due in full on booking.

GOODS AND SERVICES TAX

All goods and services offered for sale in this and associated documents, which are provided outside Australia, are exempt from Australian Goods and Services Tax. However, for goods and services and other items connected with Australia, Goods and Services Tax will apply. This is subject to change at any time should legislation be enacted affecting the current treatment of the Australian Goods and Services Tax upon the goods and services provided.

COSTS NOT INCLUDED IN PACKAGE

Costs of flights, passports or visas, meals and sightseeing other than those specified in the Tour Inclusions, gratuities/tips (unless stated), excess baggage charges, personal items such as phone calls and insurance are not included in the package costs.

PRODUCT DESCRIPTIONS & IMAGES

Descriptions featured on the GGA website are based on current information provided by hotels and ground suppliers. Any facilities shown as included are subject to change at any time. The standard of accommodation and other services are based on various factors, which are generally accepted as indicative of a certain class, however, we do not guarantee the standard, class, or fitness for purpose of that accommodation or service. Hotel ratings are those suggested by relevant local authorities or our representative and may vary from tourist office ratings. Where applicable, images featured are shown for general information and may not necessarily reflect actual locations or tour inclusions.

HOTEL INFORMATION

Check-in time at hotels is generally 2:00pm; rooms may not be ready prior to this time for immediate occupancy upon arrival. Check-out time at hotels is generally 11:00am. Rooms still occupied after the designated checkout time may incur charges that would be payable directly to the hotel.

ITINERARY CHANGES

You acknowledge that given the nature of football tours, it may be necessary for GGA to vary the tour itinerary either pre-travel or during travel. You agree and accept that GGA has discretion in this regard, and you agree that you shall have no claims against GGA in this regard.

CHANGES OF HOTELS

If for any reason the hotel(s) nominated or confirmed to you is/are unavailable, an alternative will be sought/offered. If, after confirmation, the hotel becomes unavailable, you will be assigned to a hotel of similar or superior standard.

INTERNATIONAL FLIGHTS

International flights are not included in any Travel Arrangements but are available for purchase an add-on. If You purchase international flights from GGA, then You acknowledge that You will be subject to the carrier’s conditions of carriage, which are incorporated into these Booking Conditions by reference. You also acknowledge that GGA may change Your nominated carrier prior to travel and this will be deemed a minor change and You will have no claims against GGA in this regard.

It is your responsibility to arrange international flights to meet the commencement of Your Travel Arrangements, as notified to you, unless you purchase flights separately through us.

HEALTH AND IMMIGRATION

You should familiarise Yourself with any health requirement that may be applicable in the areas You intend visiting, and You shall be responsible for all exit, entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries visited or transited.

TRAVEL INSURANCE

Travel Insurance is highly recommended to cover you against loss of deposit or final monies paid, because of unavoidable cancellation due to illness or other causes, personal baggage loss, medical expenses etc (conditions apply).

VISA REQUIREMENTS

For up to date advice on visas required for overseas travel, Australian passport holders should contact the nearest embassy or consulate of the countries they intend to visit well in advance of travel. Visas may take several weeks to process. Australians are not required to obtain a visa to visit Malaysia.

According to international regulations, passports must have at least two blank pages in them when one enters a country, and it should also not have less than 6 months to go before expiry.

Please note that passport and Visa requirements are not GGA’s responsibility and GGA is not liable for any loss or expense due to Your failure to comply with the above.

CHANGES AND CANCELLATION BY YOU

All payments are non-refundable however it will be possible to substitute passenger names up until 14 days prior to the first date of travel for a processing fee of AUD100 per name change.

MINIMUM NUMBERS

Travel Arrangements are subject to a minimum of 8 travellers. If minimum numbers have not been achieved 14 days prior to travel then we will advise You. You will have the option of accepting modified travel arrangements or accepting a refund, however We may at our discretion elect to operate the Travel Arrangements without modification, in which case We will not be required to provide You with any notice.

CHANGES AND CANCELLATION BY US

Green & Gold Army will use commercial endeavours to provide the Travel Arrangements as advertised or offered. However, it may be necessary for Us to vary or even cancel the Travel Arrangements, whether due to force majeure, operational reasons or otherwise. Where it becomes necessary for GGA to significantly vary or cancel Your Travel Arrangements, We will use reasonable endeavours to provide You with alternative Travel Arrangements that are substantially similar to Your booked Travel Arrangements. You shall not be entitled to a refund where We substantially vary Your Travel Arrangements, but You may be entitled to a price reduction. Where we cancel Your Travel Arrangements for reasons other than force majeure (see below) We shall refund payments made by You, but You shall not be entitled to make any further claims against Us.

FORCE MAJEURE

If any exceptional event or circumstance which is beyond Our reasonable control (Force Majeure) happens which causes Us not to be able to deliver the Travel Arrangements in the manner foreseen at the time of Your Booking, then You shall not be required to make any further payments to GGA, and GGA shall not be obliged to provide the Travel Arrangements to You and shall only be obliged to refund You amounts it is able to recover from its suppliers using reasonable endeavours, it being acknowledged that GGA may not be able to recover any amounts from suppliers in the event of Force Majeure.

ACCEPTANCE OF RISK

You acknowledge that the Travel Arrangements may involve personal risk. Such risks include illness, injury, disease, loss or damage to property, discomfort and inconvenience. You, in making Your Booking, accept such risks and agree that You have made Your Booking upon the condition that You travel at Your own risk. You warrant that you will not make any claim against GGA for injury or loss, howsoever caused, arising out of the acceptance of such risk.

LIMITATION OF LIABILITY

GGA will endeavour to meet its obligations to You pursuant to these Booking Conditions. However, despite those endeavours, sometimes things go wrong. Unless otherwise excluded or modified by law, GGA hereby disclaims liability for any loss of or damage to You, including loss of life or injury, and loss of or damage to any of Your property, however such loss or damage may be caused. Unless such disclaimer shall be excluded or modified by law, You warrant that You will not make or pursue any claim against GGA in respect of any such loss or damage, however caused. Notwithstanding, the maximum liability of GGA to You in contract, tort (including negligence) or breach of statutory duty, to the fullest extent permitted by law shall be limited to the refunding of any monies actually paid to GGA for Your Travel Arrangements.

You acknowledge that the provisions of this clause are reasonable and necessary for the business of GGA having regard to a range of matters including but not limited to parts of the Travel Arrangements being supplied or undertaken by third party operators. Whilst GGA has undertaken due diligence on the quality of the services offered by such third party operators, and has been satisfied as to the adequacy of that quality, it cannot be responsible for any acts or omissions on their parts.

You also acknowledge that there may be flight, rail or road delays (due to circumstances beyond the control of GGA) that may lead to interference with Travel Arrangements for which you have booked. GGA will not be responsible for any such delays or loss of flight connections whether such loss is caused by You, GGA or any of Our suppliers, airline or other. In the case of any loss of flight connections, while every effort will be made by GGA to continue with the Travel Arrangements, to the fullest extent permitted by law, GGA will not be liable to compensate you for any lost part of Your Travel Arrangements and GGA will not be liable to pay for any additional costs that may be incurred by You as a result of any loss. GGA strongly recommends that you have insurance that will cover you for flight cancellations and delays.

DISCLAIMER OF WARRANTIES

GGA excludes all implied conditions and warranties except any implied condition or warranty the exclusion of which would not contravene any statutory provision or cause any part of this clause to be void.

ENTIRE AGREEMENT & SEVERABILITY

These Booking Conditions constitute the entire agreement between you and GGA for the supply of Travel Arrangements related to Your Travel Arrangements. Any representations made GGA, or its employees, officers or agents, are expressly excluded from these Booking Conditions. If any part of these Booking Conditions are held to be unlawful and/or unenforceable and would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the Condition will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant Condition will be deemed to be deleted) without affecting any of the remaining Conditions.

LAW OF CONTRACT

These Booking Conditions are governed by the laws of Victoria, Australia and any action arising under them or in any way connected with the Travel Arrangements may be bought only in a court in Victoria, Australia (and courts entitled to hear appeals from those courts), subject to any law which is expressly inconsistent with this.
